Estates official resigns after office mishandles $2.2M inassets(NYP)The official who oversees estates of people who die without wills in Brooklyn — and whose office was cited for sloppy work by the city comptroller last year — has resigned, The Post has learned. Kings County Public Administrator Bruce Stein stepped down earlier this month, in part because of questions about his ability to perform the job, a source said. Stein’s office was slammed by former Comptroller John Liu in 2013 for mishandling more than $2.2 million in assets, including misplacing a fur coat and allowing $50,000 in cash to sit unclaimed in a safe deposit box for five years. The money was claimed only after auditors pointed it out. The auditors found shoddy work in more than half of the 50 cases that were examined. Stein was appointed to the role in January 2009, and was earning more than $123,000. He did not respond to a request for comment.

WASHINGTON — Sweeping aside complaints that New York State chooses its trial judges through an antiquated, patronage-tainted system that favors party cronies and gives voters no real say, the United States Supreme Court on Wednesday upheld the state’s unique system.  Overturning findings by a federal district judge in Brooklyn and the United States Court of Appeals for the Second Circuit, the justices held that New York’s selection of nominees for State Supreme Court by means of party conventions is both constitutional and reasonable. “Party conventions, with their attendant ‘smoke-filled rooms’ and domination by party leaders, have long been an accepted manner of selecting party candidates,” Justice Antonin Scalia wrote, in a decision that provided ample reminders that judges are politicians as well as somber, black-robed jurists. The justices rejected a lawsuit brought by Margarita Lopez Torres, a Brooklyn Surrogate Court judge who, as an elected Civil Court judge, tried unsuccessfully to get the Brooklyn Democratic Party’s backing to run for State Supreme Court. She was apparently turned away by party leaders after refusing to make patronage appointments to their liking.

 New York City Comptroller John Liu’s office conducted an audit of the Kings County Public Administrator (KCPA) and found that the KCPA mishandled many of the estates under its supervision as well as uncovering more than $2.6 million in stolen funds.
The KCPA, which is given most of its powers through Article 11 of the New York State Surrogate’s Court Procedures Act, is responsible for administering the estates of individuals in Brooklyn who die intestate, or without a will. The KCPA also handles estates when there is no individual qualified or willing to administer the estate.

We also found that KCPA failed to: (1) report its activities to oversight organizations, as required; (2) adequately review its financial transactions; and (3) track inventory it held for estates. KCPA failed to properly carry out its fiduciary responsibilities because it did not act in the best
interests of estates, carry out its duties prudently, and comply with statutory rules and
regulations. Specifically, KCPA did not implement internal controls for critical estate administration functions including asset identification, collection, safeguarding, and distribution;
estate accounting including the recording, documenting, and reporting of income and expenses
transactions; bank account administration; and estate management, monitoring, and tracking.
Additionally, KCPA failed to submit to the Surrogate‘s Court, State Attorney General, State and
City Comptroller‘s Office, and the Mayor the required financial and operational reports that
would allow them to effectively assess, monitor, and hold KCPA accountable for its
performance.  On other matters, KCPA‘s failure to establish proper internal controls to monitor and safeguard estate assets may have provided the opportunity for certain mishandling of estate activities and the recently reported misappropriation of funds. During the course of the audit, auditors became
aware of an issue involving the indictment of a KCPA bookkeeper for stealing more than $2.6
million from decedents‘ estates between August 2008 and November 2011.

The audit showed that assets in over half of the fifty estates that were examined had been mishandled.  And that’s only 50 of 3,300 estates the administrator’s office has been responsible for since June 2011.
Among the missteps, Liu claims the administrator’s office left $50,000 sitting in a safe deposit box for five years, failed to credit an estate after selling a home for $140,000, and misplaced a $1,000 fur coat.
Public Administrator Bruce Stein responded to Liu’s audit with an itemized refutation of its findings.

 

The audit showed that assets in over half of the fifty estates that were examined had been mishandled.  And that’s only 50 of 3,300 estates the administrator’s office has been responsible for since June 2011.

KCPA Bruce Stein adamantly defended his office. Liu found that assertion unsatisfactory, noting that the KCPA and not the OCA is “responsible for substantively reviewing and approving estate expenses — including legal counsel fees. Accordingly, KCPA should have ensured that such expenses were authorized and appropriate. “
Liu countered that the Stein “may have prevented rather than detected the reported misappropriation of funds” had he instituted internal controls.
The public administrator oversees the estates of people who die without wills, and if no relatives claim the funds, the assets are transferred to the city Department of Finance.
Paul, who oversaw the process as a clerk for the public administrator, manipulated the checks to enrich himself and his pals between 2008 and November 2011.

A former employee of a Brooklyn governmental office has been arrested and charged with illegally pocketing $13,268, some of it from a deceased person's safe-deposit box.
Arthur Orikher, who was employed at the Kings County Public Administrator's Office, could face up to seven years in prison, according to a statement issued by the city's Department of Investigation. The Public Administrator's Office administers the estates of individuals who die without wills or without families who can administer their estates.
Just three months after being hired to perform accounting duties at the office, Mr. Orikher began depositing counterfeit checks worth $9,969 into his personal account, the commissioner of the DOI, Rose Gill Hearn, said.
Then, on April 30, Mr. Orikher stole $3,300 that had been collected from a deceased client's safe-deposit box.
"The charged conduct obviously violates the fundamental obligations and standards of personal integrity required of any public servant, to say nothing of one paid by the City to conserve the money and valuables of the deceased," Ms. Hearn said in the statement.

Bronx Surrogate Judge Lee Holzman keeps his job despite breaking the rules(NYDN Ed) State Commission on Judicial Conduct goes way too easy on a rotten judge.  In one of the worst rulings in its history, the state Commission on Judicial Conduct decreed that a judge may stay on the bench despite giving a pass to a lawyer friend who’d grabbed hundreds of thousand of dollars in excessive fees from the estates of the dead. When Holzman’s counsel, Michael Lippman, got caught taking far larger amounts than he was entitled to, Holzman kept him on the job. That way, Lippman was supposed to earn more fees so he could repay the filched funds.Despite citing all these facts, the panel painted Holzman, incredibly, as a misguided soul who clumsily set out to make whole the estates damaged by Lippman. Thus, he will leave his judgeship under his own power, setting a precedent that casual malfeasance will be tolerated.

Bronx Surrogate Judge Lee Holzman keeps his job despite breaking the rules(NYDN Ed) State Commission on Judicial Conduct goes way too easy on a rotten judge.  In one of the worst rulings in its history, the state Commission on Judicial Conduct decreed that a judge may stay on the bench despite giving a pass to a lawyer friend who’d grabbed hundreds of thousand of dollars in excessive fees from the estates of the dead. When Holzman’s counsel, Michael Lippman, got caught taking far larger amounts than he was entitled to, Holzman kept him on the job. That way, Lippman was supposed to earn more fees so he could repay the filched funds.Despite citing all these facts, the panel painted Holzman, incredibly, as a misguided soul who clumsily set out to make whole the estates damaged by Lippman. Thus, he will leave his judgeship under his own power, setting a precedent that casual malfeasance will be tolerated.

The Post is livid that Manhattan Surrogate Judge Nora Anderson got off “scot-free” for violating campaign finance laws and was only censured for her actions
Judicial panel, heal thy self(NYP) To wit, despite being officially censured for eye-popping campaign conduct, Manhattan Surrogate Judge Nora Anderson essentially gets off scot-free. As a candidate for surrogate in 2008, Anderson accepted a ton of money from her mentor and former law partner, Seth Rubenstein: He gave the campaign $25,000 and loaned it another $225,000.
Still, Anderson’s campaign needed more cash — and Rubenstein had donated the legal maximum. So the two of them did an end-run around campaign-finance laws. He wired a $150,000 “gift” to Anderson’s personal account — then, declaring it her own money (which is not limited by law), she funneled it into her campaign.  A pretty obvious dodge — which is why the two were later indicted on felony charges. But most of the counts were dismissed by a judge who agreed that they should have been brought in Brooklyn, where the transactions took place, instead of Manhattan. Anderson and Rubenstein were later acquitted on the remaining, less serious counts, and Brooklyn DA Joe Hynes never brought any charges. (No surprise there.).  Enter the commission, which bought her argument (among other things) that she’d relied on Rubenstein — her co-perpetrator — for legal advice and that she didn’t intend to break state election law. There wasn’t a single dissent.

Pay to Play Bronx Judges

Politics plays key role in Bronx court appointments(Riverdale Press) Despite years of reforms, in some Bronx courtrooms, it is still just as helpful to know the judge as the law. Sometimes, it’s even more so. That’s the finding of a Riverdale Press review of discretionary appointments by local judges and the legal practices of politically connected attorneys who often appear before them.As a Supreme Court judge, Nelida Malave-Gonzalez, who was elected in November as the Bronx’s new judge of the surrogate court, repeatedly tapped leaders of the Bronx Democratic County Committee, commonly referred to as the Bronx Democratic Party, to serve as court-appointed counsels, designations that yielded tens of thousands of dollars in fees. Since she began making appointments in 2010, Judge Malave-Gonzalez’s most frequent appointee, records show, has been Assemblyman Jeffrey Dinowitz, who has represented Riverdale and Kingsbridge in Albany for 19 years and who serves as chair of the Bronx Democratic Party’s county committee.
