Terrorism and the City #888

NYPD Beefs Up Security At Christmass Markets After Fatal Truck Attack in Germany

NYPD to beef up security at Christmas markets after fatalBerlin truck attack (NYDN) The NYPD will send counter-terrorism officers to the city’s outdoor Christmas markets and other high-profile spots in response to a truck attack in Berlin that killed at least 12 people Monday, authorities said. The move comes after a tractor-trailer plowed into Christmas shoppers near the German capital’s Kaiser Wilhelm Memorial Church Monday around 8 p.m.* New York City beefed up security around outdoor markets following a terrorist attack in Berlin on Monday, where a dozen people were killed when a driver drove a stolen truck into a crowd of holiday shoppers, Politico New York reports. * ‘Density of traffic’ protects NYC against truck attack: NYPD chief (NYP)

WH Cuts NY's Terror Funds By 50%

Bratton Schumer Iran Payback?

NYPD Commissioner Bill Bratton said that the White House’s proposed cut of about half the money the city gets for anti-terror funding may be “political payback” against U.S. Sen. Charles Schumer, who voted against the nuclear deal with Iran, Politico New York reports:   *  The Post defends U.S. Sen. Charles Schumer against criticism from the Obama administration over homeland security funding cuts, saying “someone’s credibility is open to question,” but “it’s not Chuck Schumer’s”:OBAMA TURNS HIS BACK ON NYC'S SAFETY: Anti-terror fund for city is slashed by $90 MILLION due to petty politics, as Blaz and Bratton blast potentially 'disastrous' decision (NYDN) *  Obama the slasher (NYDN Ed) With ISIS on the rise in spreading terrorist havens across the Middle East and beyond, President Obama has called for drastically slashing New York’s federal anti-terror funding. Chuck Schumer’s credibility on national security after he joined New York City officials challenging the administration’s decision to reduce financing for grants supporting local counterterrorism, the Times reports:\ * Slashing New York’s federal anti-terror funding would be so devastating to security that the New York City Police Department and the state’s Democratic hierarchy are desperately searching for a rational explanation, the Daily News writes * In an extraordinary attack, the White House slammed U.S. Sen. Charles Schumer for criticizing the administration’s proposed cuts to homeland security funding, labeling Schumer “wrong” and even calling his “credibility” on homeland security into question by digging up a sore point in his voting record. * “At some point, Senator Schumer’s credibility in talking about national security issues, particularly when the facts are as they are when it relates to homeland security, have to be affected by the position that he’s taken on other issues,” White House spokesman Josh Earnest said. *Bratton furious over Obama’s anti-terror funding cut(NYP) * Team Obama’s insane slam at Chuck Schumer (NYP) * The mayor said such funding cuts is “no place to cut corners” given the threats the city faces. * Despite criticism from the White House, Sen. NYE Upstate ISIS Attack Broken Up

Cuomo Urges Vigilance After Rochester Terror Arrest (YNN) Cuomo urged New Yorkers to remain vigilant after federal law enforcement officers arrested a Rochester man suspected of providing material support for an Islamic State attack on New Year’s Eve.The attack was planned for an unnamed Rochester restaurant or bar that had been chosen by Emanuel Lutchman, who was reportedly radicalized while serving time in prison.* Emanuel Lutchman, a 25-year-old man in Rochester, was arrested and charged withplanning a New Year’s Eve machete attack on diners on behalf of the IslamicState, The New York Times reports: ** Gov. City to Appoint Counterterrorism Monitor As NYPD Continues Surveillance of Muslims
The Daily News criticizes the NYPD’s settlement over surveillance of Muslims after the Sept. 11 attacks, saying the agreement accepted by City Hall included terms that are easily distorted to paint the NYPD as guilty
New York to Appoint Civilian to Monitor Police’s Counterterrorism Activity (NYT) An agreement, coming as the city moves to settle lawsuits over surveillance targeting Muslims, would restore some of the outside oversight that was eliminated after the Sept. 11 attacks.* NYPD will yank terror report from website to settle case over spying (NYP) * Civilian Representative to Join NYPD Counterterror Oversight Panel (NY1) *  Hamstringing the NYPD’s anti-terror efforts (NYP) Start with the mayor’s appointment of an outside lawyer to “spy” on NYPD counterterror programs, push back when he thinks it crosses some line and complain to the commissioner, mayor or a federal judge. The department can ignore him, but the added pressure, even when he’s wrong, can’t help. The deal will also limit the time of NYPD probes and its use of undercovers.

The NYPD  settlement over surveillance of Muslims after 9/11 confirms cops were right all along in saying they did nothing wrong, but it castigates them for being right about radicalization, The Wall Street Journal writes:
NYPD-Muslim settlement demolishes the big spy lie (NYDN Ed) Amid global fears of ISIS-inspired, home-grown radical Islamist attacks, the NYPD’s anti-terror intelligence program won vindication Thursday in a lawsuit that had alleged wholesale unconstitutional spying on Muslims. Victory, though, was not fully sweet, because the settlement accepted by City Hall included terms that are easily distorted to paint the NYPD as guilty. Six Muslim individuals, mosques and organizations asked a federal judge in 2013 to declare the NYPD filled with anti-Muslim spies, to bar the department from continuing its operations and to order the destruction of all collected information.  Critically, certifying that their case was baseless — that there was no merit to the much-trumpeted accusation of spying — the claimants came away with none of that. The NYPD paid no compensation, made no admissions of wrongdoing and escaped without paying the other side’s legal fees. Lacking proof after examining the department’s innards, the ACLU-represented accusers had no choice but to fold. Then, too, some of their backgrounds directly demolished charges of “suspicionless surveillance.” In court papers, the NYPD had revealed, for example, that it had probed individuals associated with one of the mosques “based upon information about their lengthy history of suspected criminal activity, some of it terroristic in nature,” such as illegal weapons trafficking and support for “government-designated terrorist organizations.”   So much for suspicionless surveillance. The NYPD also accepted the appointment of a civilian who will monitor compliance with the settlement for the next five years. While Deputy Commissioner for Intelligence John Miller said he welcomed the oversight as a way to put the spying accusations to rest, its introduction under these circumstances created a shadow where none should exist. Most distastefully, the NYPD agreed to stifle a landmark 2007 report that investigated for the first time the process of Islamist radicalization. After studying numerous plots, including the conspiracy to bomb the Herald Square subway station, NYPD analysts noted that many perpetrators were disaffected young men who had gravitated to radical Islamist beliefs.*  The New York Police Department must strengthen oversight of its surveillance practices as part of a settlement of two civil-rights lawsuits accusing the force of unfairly monitoring Muslims after the Sept. 11, 2001, terror attacks.

NYC Got the Same Audit As LA
Bratton says LA overreacted: NYC schools got same threat (NYP) New York City school officials received the same bomb threat early Tuesday thatprompted the closure of the Los Angeles school system, but police quickly concluded that it was a hoax.  Mayor Bill de Blasio told reporters that he is “absolutely convinced” that there was no danger to schoolchildren in New York. New York Police Commissioner William Bratton said he thinks Los Angeles officials engaged in a “significant overreaction” by deciding to close the nation’s second-largest school system. The threat, they said, came in the form of a “generic” email sent to many cities around the country. In New York, it was received by a school superintendent early Tuesday.* LAPD Chief calls Bratton "irresponsible" forcriticizing L.A.'sschool threat response: (DNAINFO) * The New York Police Department is investigating a threat to the city’s school system, but NYPD Commissioner Bill Bratton said there was no indication that the threat, received Tuesday morning, was credible, The NewYork Times writes:

He rejected former Mayor Rudy Giuliani’s call to return to the policy, which Giuliani started in the ’90s and which remained in place until de Blasio ended it last year.* Freeing up the NYPD is the safest way to welcome refugees (NYP Ed) Could the biggest obstacle to welcoming refugees from the Syrian war into New York and New Jersey turn out to be left-wing lawyers who want the courts to curtail the ability of our cops to keep an eye on the Muslim community? That’s no theoretical question. Not after the US Court of Appeals for the Third Circuit revived the lawsuit against New York City and its police department for gathering intelligence in the Muslim communities in the wake of 9/11.

The unidentified men were spotted recording cell-phone footage outside the Congregation Bet Yaakob at 1801 Ocean Parkway and nearby Congregation Beth Torah at 1061 Ocean Parkway starting about 4 p.m., sources said. They drove off in a car with expired plates. Surveillance footage from outside Congregation Bet Yaakob showed one man in a black jacket and blue jeans posing in front of the synagogue on Ocean parkway and Avenue R while his bearded buddy taped him. A security guard from the synagogue eventually shoos them away.

Will the Mayor Ask the French What They Think About Targeting Muslim Terrorists?
All against all: NYC’s policing war(NYP, Thomas A. Reppetto) Are the people who run the NYPD — headquarters brass, union officials, the mayor’s office, city lawyers — ever going to get on the same page, or will it take another disaster to wake them up? The latest news is that the NYPD may cut back on its investigations of self-radicalized potential domestic terrorists who happen to be Muslims. Supposedly, this will be done to pacify critics who’ve been suing the city. The notion that authorities can’t target particular groups for investigation is ridiculous. It’s like telling the cops who blanketed mafia hangouts a generation ago that they shouldn’t have paid attention to such places.Right now, city authorities seem to be spending more time in a war of all against all than in doing their jobs.* * The bloody attacks on Charlie Hebdo and a kosher grocery store in Paris leave a lesson for New York: Jihad no longer comes exclusively from abroad, as radicalized Muslims within our midst can be just as lethal, the Post writes:
Remember, the present turmoil is most likely being watched carefully by people who’d like nothing more than to exploit our weaknesses to carry out a successful terror attack. The current crisis of police morale and performance is almost an invitation to a terrorist strike at the world’s most important city. That’s one key reason for the governor to ensure that New York law enforcement presents a strong and united front. No leader need ever apologize for fighting crime and terrorism. The recent polls confirm this: City residents want an end to the name-calling and infighting, and vigorous action against all threats to safety. Thomas A. Reppetto is past president of the Citizens Crime Commission of New York City and a former commander of detectives in the Chicago Police Department.

Does the City Understand History . . .  It Started In Europe Last Time Also
City may yank terrorism report to appease mosque ‘spying’ critics(NYP) In top-secret talks to settle federal lawsuits against the NYPD for monitoring mosques, the city is weighing a demand that it scrub from its Web site a report on Islamic terrorists, The Post has learned. The groundbreaking, 92-page report, titled “Radicalization in the West: The Homegrown Threat,” angers critics who say it promotes “religious profiling” and discrimination against Muslims. But law-enforcement sources say removing the report now would come at the worst time — after mounting terror attacks by Islamic extremists in Paris, Boston, Sydney and Ottawa. Here in New York, Zale Thompson, a man who heeded online calls by ISIS for jihad, attacked two NYPD officers with a hatchet in October. “The harm is that it sends the message that the NYPD is going to back down on its counterterrorism effort in the name of political correctness,” said a former NYPD official. “Shame on the NYPD if they do.”

for whom the bell tolls (Europe) it tolls for thee (America)
Sources familiar with the case confirmed that removal of the NYPD report is one of the major sticking points in settlement negotiations. Also on the table are demands that the NYPD halt any ongoing surveillance in the Muslim community and that records of prior monitoring be expunged, sources said. With what seems today like a crystal ball, the 2007 NYPD report identified an “emerging threat” — al Qaeda-inspired jihadists in the United States and abroad, hell-bent on attacking their host countries. Under former Police Commissioner Ray Kelly, the report served as a blueprint for the NYPD’s “demographic unit,” which sent plainclothes detectives into Muslim cafes, stores and mosques to detect potential terrorists. After the initiative was exposed by The Associated Press, Muslim leaders and groups filed two lawsuits in Brooklyn federal court claiming they were subjected to unwarranted surveillance. The suits complain the radicalization report puts virtually all Muslims under suspicion. Last April, Police Commissioner Bill Bratton disbanded the intelligence-gathering unit. De Blasio under fire amid new threat from Islamic Statefighters(The Hill) New York City Mayor Bill de Blasio is coming under sharp criticism for making decisions that may have undermined the effectiveness of his police department’s counter-terrorism operations. Thirteen years after the 9/11 attacks on Manhattan, prominent security experts say de Blasio has made fighting terrorism a lower priority in order to appease the communities that helped elect him.
“A classic case of taking your eye off the ball at the worst possible time is Mayor de Blasio in New York,” said John Lehman, a former member of the 9/11 Commission. He said de Blasio is failing to take seriously enough the new threat posed to New York and other major American cities by the Islamic State in Iraq and Syria (ISIS), which has reportedly trained dozens of American jihadists. “At the very time when the threat suddenly emerges in a whole new additional form focused on the U.S., he decides to end some of the most effective programs in the country in the NYPD counterterrorism unit,” Lehman said. “He has reassigned people and vehicles and special equipment to non-counterterrorist activities,” he added. In April, de Blasio disbanded a special unit tasked with conducting surveillance of mosques and Muslim groups suspected of radical ties.  Michael Mukasey, who served as U.S. attorney general from 2007 to 2009, said the unit was instrumental in mapping out possible terrorist ties within Muslim communities. “They weren’t simply conducting surveillance of mosques and Muslims. They were mapping communities, figuring out where someone from Lebanon or Yemen or any of the other hot spots would go if they wanted to come to this country and find refuge,” he said.*Mayor applies for security clearance after Post story (NYP)*NYT editorial: Obama’s plan to rely on Syrian rebels “isfull of hope and fraught with obstacles.” * Warning of Terror Risk, Three Leaders Showcase Their Focuson Safety(NYT)In a rare joint appearance, New Jersey Gov. Ray Was Right(NYP)The NYPD and its former boss, Ray Kelly, got two big wins in their war on terror last week. In Newark, US District Judge William Martini tossed a lawsuit against the NYPD’s surveillance of Muslim communities. It was a clear-cut vindication of the cops and their anti-terror programs. The day before Martini’s decision, the NYPD scored another victory: Word came that José Pimentel (a k a Muhammad Yusuf) had pleaded guilty to plotting to bomb the city. As a result, he faces 16 years in prison when sentenced next month. As a candidate, Bill de Blasio vowed to rein in NYPD surveillance practices.
